These Terms of Service (“Terms”) are an agreement between you and Muse Entertainment LLC, a Delaware limited liability company at 16192 Coastal Highway, Lewes, DE 19958 (“Muse Entertainment”, “TourMuse”, “we”, “us”, “our”).
Please read section 23 (Limitation of liability) and section 25 (Governing law and disputes) carefully. Section 25 requires most disputes to be resolved by individual arbitration and limits your right to bring a class action. You may opt out of arbitration within 30 days.
1. What these Terms cover
These Terms govern your use of:
- the TourMuse mobile apps for iOS and Android;
- the TourMuse web app at
app.tourmuse.app, the full application in a browser; - the TourMuse website at
tourmuse.app, including the waitlist page; and - everything we offer through them,
together, the “Service”.
1.1 Documents that form part of this agreement
These Terms incorporate, and you also agree to:
- the Privacy Policy — what we collect and why;
- the Cookie Policy — what is stored on your device;
- the Refund Policy — when Tickets are returned; and
- the Copyright Policy and DMCA Notices — copyright complaints and repeat infringers.
Together with these Terms they are the entire agreement between you and Muse Entertainment about the Service. If one of them conflicts with these Terms on a point it covers in detail, that document governs that point.
2. Accepting these Terms
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service for an organization, you confirm you have authority to bind it, and “you” means both you and that organization.
3. Who may use TourMuse
You must be at least 13 years old to have a TourMuse account. We do not knowingly allow anyone under 13 to use it. If you are 13 to 17, some features work differently and some are unavailable until you turn 18; section 3.1 lists them.
When you create an account we ask for your date of birth, and you confirm that the information you give us is accurate. We may ask for proof of age where we have reason to doubt it, and we may suspend or close accounts we believe do not meet these requirements. If we learn that an account belongs to someone under 13, we close it and delete the personal information we hold, as the Privacy Policy describes.
If you are under 18, a parent or guardian is responsible for your purchases and for your conduct on the Service, and you should take a Tour or Quest in person only with their agreement (section 14).
3.1 If you are 13 to 17
Until the day you turn 18, these limits apply to your account, and we tell you about each of them where it comes up in the app. They are the only differences; everything else works as it does for anyone.
- Publishing. You may publish a Tour of one stop. It is free, it has no location, and any Quest in it must be at a Verified Location. You may take it down at any time, and it then disappears for everyone (section 9.4).
- Money. You cannot earn royalties (section 9.3), register for payouts, or gift or receive gifts of Tickets (section 6.4). You may buy Ticket Books through the app stores, subject to any family controls on your store account.
- Messages. You and an adult can message each other directly only when you follow each other, and an adult can add you to a group only if you follow each other and everyone else in it does too.
- Where you are. Your Tours carry no location, your posts cannot reference a place, your passport stamps are private unless you make them public, and precise location is collected only while a Tour or Quest is active, with a signal on screen (section 14).
- What you see. Your feed shows the people you follow, newest first, with no ranking. You cannot see or book Tours rated for mature audiences. You receive no promotional notifications, and none at all between midnight and 6 a.m.
- Verified Locations. You cannot claim one.
- Reports. A report about you, or about something you posted, is handled by a person on our safety track ahead of other reports (section 17), and a Tour you publish is checked before it appears (section 9.1).
On your 18th birthday these limits lift. The app will ask you to read and accept these Terms again as an adult; the publishing limits stay on any Tour you published before then until you publish it again.
Purchases are made through the Apple App Store or Google Play and are subject to those stores’ terms.
4. Your account
Keep your sign-in details to yourself. You are responsible for what happens under your account, and you agree to tell us promptly if you think someone else is using it.
Give us accurate registration information and keep it up to date.
You may close your account at any time from within the app. Before you do, read section 6.5 — closing your account permanently forfeits any unspent Tickets and all access to Tours you have booked.
5. What TourMuse is
TourMuse has two kinds of user. A User (in the app, a Muser) browses and takes part in place-based experiences called Tours. A Creator (in the app, a Muse) writes and publishes them. One account can be both.
Tours may be historical, artistic, athletic, real-estate or inspirational, or How-To and DIY. They may include Quests, points, achievements, leaderboards and location-verified achievements, and a social feed called Musing. Tours can be taken in person, with location-activated guidance, or virtually.
TourMuse sells self-guided digital Tours. Creators are independent of Muse Entertainment. We do not organize, staff, supervise or verify in-person guided tours, and we are not a party to any arrangement you make with a guide, an operator or a venue. We do not review Tours for accuracy or safety before they are published, and publishing a Tour is not an endorsement of it.
We may add, change or discontinue features at any time.
6. Tickets, Ticket Books and bookings
This section describes how value works in TourMuse. The Refund Policy uses the same words.
6.1 The two steps
You purchase a Ticket Book with money, through the Apple App Store or Google Play. That credits a number of Tickets to your account balance. You then book a Tour by spending Tickets. The number of Tickets a Tour costs is set by its Creator; many Tours are free.
6.2 What a Ticket is
A Ticket is a limited, personal, revocable license to unlock content inside TourMuse. It is not property, not currency, not a gift card, not a stored-value or prepaid-access product, and not a security or financial instrument.
- Tickets have no cash value and cannot be redeemed for money, except where the law requires otherwise.
- Tickets can be spent only inside TourMuse, on TourMuse content. There is no cash-out.
- We do not publish an exchange rate between Tickets and any currency.
- Tickets do not expire.
- We may adjust a balance to correct an error, to reverse a purchase that was refunded, charged back or reversed by the App Store or Google Play, or to reverse Tickets credited through fraud or abuse.
6.3 Buying Tickets
The only official way to buy Tickets is a Ticket Book bought inside the TourMuse app through the Apple App Store or Google Play. We do not sell Tickets on any website, through any reseller or marketplace, or through any other service. We cannot support, replace or refund Tickets obtained from any other source, and we may remove Tickets credited as a result of a purchase we cannot verify.
6.4 Gifting
Where the app offers it, you may gift Tickets to another TourMuse user. Gifting is not available to or from an account of a user under 18. Gifts are final and cannot be reversed by us. Tickets may not be sold, traded, or exchanged for money or anything of value outside TourMuse, and any attempt to do so may result in the Tickets being removed and the accounts involved closed.
6.5 What happens to Tickets when an account ends
- If you close your account, any unspent Tickets and all access to Tours you have booked are permanently lost. They cannot be recovered, transferred or refunded. Spend or gift your Tickets first; if you are under 18, spend them, since gifting is not available to you.
- If we close or suspend your account for breach of these Terms, unspent Tickets may be forfeited.
6.6 Booked Tours
Booking a Tour gives you a personal, non-transferable license to play it inside TourMuse for as long as we offer the Service. It does not give you ownership of the Tour or the right to copy, record, redistribute or publicly perform it.
A Creator may Retire a Tour, which stops new bookings but leaves it in the library of everyone who already booked it. We may Withdraw a Tour, which removes it from TourMuse for everyone — for example after a copyright complaint, a court order or a breach of these Terms. The Refund Policy explains what you get back in each case.
A Tour published by a user under 18 may be taken down by its Creator at any time. It is free, and when it is taken down it leaves your library too, downloaded or not. Nothing is owed for it.
7. Payment
Apple and Google are the merchant of record for every purchase. You pay them, under their terms, using the payment method on your Apple Account or Google account. Muse Entertainment does not charge your payment method, does not receive your card or bank details, and cannot process, reverse or refund a money payment.
Prices for Ticket Books are shown in the app before you buy and are set per country by the stores. All amounts are exclusive of taxes unless stated otherwise; taxes are handled by the store or by you, as applicable.
8. Refunds
Refunds are governed by the Refund Policy, which forms part of these Terms. In summary:
- Money refunds for a Ticket Book are handled by Apple or Google only. We have no ability to refund money.
- We refund Tickets, returned to the balance of the account that spent them, in the circumstances the Refund Policy sets out — including when a Tour will not play, when we Withdraw a Tour, and when a Tour is materially not as described.
- Nothing in these Terms limits any statutory consumer right you have that cannot be limited by agreement. See section 23.4.
9. Creators
9.1 Publishing
Any user may become a Creator. There is no minimum follower count or audience size. You may build Tours from photos, video, audio and step-by-step direction, build in Quests, and pin GPS coordinates so that certain achievements unlock only when a User is physically present.
Tours must not contain adult content, in any segment, preview, thumbnail or description — see section 16.1. There is no adult or age-restricted category on TourMuse, so no rating or warning makes it allowed.
You are responsible for the accuracy of the coordinates you pin, for the safety of the route you describe, and for having the right to direct people to the places you reference. Do not pin a coordinate that requires a User to trespass, to enter a place they are not permitted to be, or to put themselves in danger to reach.
If you are under 18 you may publish a Tour of one stop. It is free, it has no location, and any Quest in it must be at a Verified Location. You may take it down at any time, and it then disappears for everyone (section 9.4). The text and media of every Tour, whoever publishes it, are checked automatically before it appears; a Tour published by a user under 18 that the checks question is held until a person has looked at it.
9.2 Pricing
You set the price of your Tour in Tickets, or make it free. You do not set a money price; money prices belong to Ticket Books and are set by the stores.
9.3 Royalties and payouts
Muse Entertainment receives revenue from Apple and Google for Ticket Book sales, and pays Creators a royalty out of that revenue when their Tours are booked. Your royalty is 85% to 90% of the net receipts from each booking of your Tour: the Ticket price you set, valued at what we actually receive from Apple or Google for those Tickets after their fees and any taxes they withhold. The exact percentage within that range is shown in the app before you publish a paid Tour. A royalty is a payment from us to you; it is not a share of any particular User’s payment and you do not accept Tickets as payment.
- Payouts are made through our payout provider, which will ask you to verify your identity and provide tax information before you can be paid. Their terms apply to that relationship, and they — not we — hold your bank details.
- Payouts are available only in the countries listed in the app at the time you register. We may add or remove countries.
- You are responsible for your own taxes on what you earn. We or our payout provider may be required to report your earnings to a tax authority and to withhold where the law requires.
- We may withhold or reverse a royalty that accrued on a booking that was refunded, charged back, or made through fraud or abuse, and on any Tour we Withdraw.
- If your account is closed for breach of these Terms, unpaid royalties may be withheld to the extent the law allows.
- Royalties and payouts are not available to a Creator under 18. A Tour published by a user under 18 is free, so nothing accrues on it. Royalties begin on bookings made after a Tour is priced, which can happen only from your 18th birthday.
9.4 Retiring your work
You may Retire a Tour at any time, which stops new bookings. Retiring does not remove it from the libraries of Users who already booked it. If you need a Tour removed from TourMuse entirely, ask us — that is a Withdrawal, and only we can make one.
If you are under 18, retiring is a take-down: the Tour is removed for everyone, including anyone who had it in their library, and we keep no copy of the published Tour. Your draft stays with you, and you may publish it again. A Tour you published before turning 18 keeps this meaning until you publish it again as an adult.
10. Your Content
10.1 What Content means
“Content” means anything you upload, create or submit through the Service: photos, video, audio, text, route and location data, Quest structures, profile information, Musings and messages — whether or not you publish it.
You confirm that you own or have all the rights needed to submit your Content, and that it does not infringe anyone else’s rights or break the law.
10.2 Before you publish
While your Content is unpublished, you keep all ownership of it. You grant us a worldwide, royalty-free, non-exclusive license to host, store and process it only as needed to run the Service — to show you your own draft, to run automated content checks, and to help you with support.
10.3 When you publish
When you publish a Tour, Quest or other Content so that it becomes available to Users (“Published Content”), you keep ownership of it and you grant Muse Entertainment LLC an exclusive license to it, worldwide, for the full term of copyright, with the right to sublicense (for example to the app stores and to the providers that host and deliver the Service) and to transfer the license with our business. The license lets us:
- host, store, reproduce, display, perform, stream and distribute the Published Content through the Service, and keep it in the libraries of Users who have booked it;
- adapt it as needed to deliver it — convert formats, caption, translate, excerpt a free preview, fit it to a screen;
- use excerpts, thumbnails and descriptions of it to promote the Published Content and the Service;
- keep a published Tour available after you stop using the Service, as sections 6.6 and 9.4 describe; and
- enforce rights in it against people who copy it, in our name or yours, with your cooperation where the law requires you to join.
It covers the photographs, video, audio, narration, written text, and route and location data that make up the Published Content, and the arrangement, structure and sequencing of a Tour or Quest to the extent copyright protects them. Copyright protects the way an idea is expressed, not the idea, method or system itself, and this license reaches only what the law allows to be licensed.
The royalties in section 9.3 are what you receive for this license.
Exclusive means that while a Tour or Quest is published on TourMuse, you will not publish or license it, or a substantially similar guided experience built from it, on another service. Section 10.4 says what you may still do.
How long it lasts. If you Retire a Tour, the license continues for the Users who already booked it, as section 6.6 promises them, and the exclusivity ends. If a Tour is Withdrawn, the license ends for everyone, except for records we are required or entitled to keep under these Terms and the law.
A Creator who published while under 18 confirms the license to that Published Content when they accept these Terms as an adult, as section 3.1 describes.
You agree to sign any further document we reasonably need to confirm or record the license, and you waive any moral rights in the Published Content as far as the law allows. Nothing in this section waives any right you have that the law says cannot be given up by agreement, including an author’s statutory right to terminate a grant of copyright.
10.4 What you keep
Because you own your Published Content:
- you may use the individual photographs, video, audio and text in it for anything else, including commercially — the exclusivity in section 10.3 applies to the Tour or Quest as published, not to the materials it is made from;
- you may display and reference the Published Content for your own portfolio and promotion — on a personal website or your own social media, for example — with attribution to TourMuse; and
- you may Retire it at any time (section 9.4), and you may ask us to Withdraw it.
10.5 Feedback
If you send us ideas, suggestions or bug reports, we may use them for any purpose, with no obligation to you.
11. TourMuse’s own intellectual property
The TourMuse name, the “Life’s a Musing” tagline, the Trunky mascot, the logos and brand elements, and the software behind the Service are the property of Muse Entertainment LLC. These Terms give you no right to use them without our written permission.
Everything on the Service that we provide, rather than a user, is ours or our licensors’. You may use the Service and, where it allows, save or print pages for your own personal reference. Anything else — copying, redistributing, or making derivative works — needs our written consent.
12. Location
Some features need your device’s precise location: in-person step-by-step guidance, and confirming that you are physically at a coordinate a Creator pinned before an achievement unlocks. By turning these on you consent to us collecting and using your location for those purposes. The Privacy Policy explains this in full, including how long we keep it.
You can turn location off at any time in your device settings. Location-dependent features will stop working; the rest of the Service, including virtual Tours, will not.
Some Quests ask you to take a photo of your surroundings and use your device’s motion sensors to confirm the photo was taken live. Be considerate of other people when you do.
13. Points, achievements and leaderboards
Points, achievements, badges and leaderboard positions are for entertainment. They are not Tickets. They have no cash value, cannot be bought, sold, redeemed or transferred, and we may reset, adjust or remove them at any time — to correct an error, or to deal with abuse such as falsified location data.
14. Safety, and the risks you accept
TourMuse sends you to real places, and the real world is not under our control.
You are responsible for your own safety. When you take a Tour or a Quest:
- Obey the law, including traffic and trespass law. A pinned coordinate is not permission to enter anywhere.
- Pay attention to your surroundings rather than your screen. Do not use the app while driving.
- Judge for yourself whether a route, a place, a time of day or the weather is safe for you, and stop if it is not. No achievement is worth an injury.
- Take account of your own health and abilities, particularly on athletic Tours.
- In an emergency, contact your local emergency services. We cannot help you in real time.
- If you are under 18, do not take or make an in-person Tour or Quest without a parent or guardian’s agreement. While a Tour or Quest is active the app collects your precise location and shows a signal on screen; it collects none at other times.
We do not inspect routes, verify that places are safe or open, or check that a Tour can be completed safely. To the extent the law allows, you accept the risks of taking part in an in-person Tour or Quest, and you are responsible for your own decisions about where to go and what to do.
15. Tours are not professional advice
Tours are made by independent Creators. Nothing in a Tour is professional advice, and we do not check it. This matters most for:
- How-To and DIY Tours — what is described may not be safe, legal, or right for your situation. If a task needs a qualified professional, use one.
- Real-estate and inspirational Tours — nothing in a Tour is a valuation, a survey, an offer, or advice about a property or an investment.
- Athletic Tours — nothing in a Tour is medical or fitness advice. Talk to a doctor before starting something strenuous.
16. Rules of conduct
You agree not to:
- Falsify your location or otherwise defeat location verification.
- Publish Content that is unlawful, infringing, defamatory, hateful, or that you do not have the right to share.
- Post adult content anywhere on the Service, or use the Service to seek, offer or arrange sexual encounters or services (section 16.1).
- Harass, threaten, endanger, stalk or impersonate anyone.
- Publish another person’s private information, or photograph people in a way that would breach their privacy.
- Take payment outside TourMuse’s Ticket system for access to a Tour, or direct users off the Service to avoid it.
- Buy, sell or trade Tickets or accounts for money or anything of value.
- Create Tours that require or encourage trespass, unsafe behavior, or breaking the law.
- Reverse-engineer, scrape, harvest from, or interfere with the Service or its security, or circumvent any limit or access control.
- Introduce malware, or try to reach any account, server or system you are not authorized to use.
- Send spam or unsolicited promotion.
- Use the Service to train a machine-learning model on other users’ Content without their permission and ours.
16.1 No adult content
Adult content is prohibited everywhere on TourMuse. That means Tours and every part of them, free previews, thumbnails and descriptions, Musings, Tour comments, profiles, usernames and avatars, group names, Verified Location pages, direct and group messages and their attachments, and links to anything of this kind elsewhere. There is no age-restricted category for it. Marking a Tour as being for adults does not make adult content allowed.
What we mean by adult content:
- Sexual activity, real or simulated, shown or described explicitly — in images, video, audio, narration or text.
- Nudity or bodies presented sexually — content posed, framed, cropped, captioned or narrated to draw attention to genitals, buttocks or breasts, or that is otherwise sexually suggestive, whether or not anything is fully exposed. This includes lewd and fetish content and sexualized depictions of any person, clothed or not.
- Sexual services and solicitation — offering, seeking or advertising sex, sexual services or sexual encounters; using the Service to arrange them; and promoting or linking to pornography or adult services.
- Sexual content involving anyone under 18, real, simulated, drawn or generated. We do not treat this as adult content; it is child sexual abuse material, and section 17 says what we do about it.
What is not adult content. TourMuse is used to explore museums, galleries, monuments and the history of places, and we do not treat the following as adult content when it is presented for its artistic, educational, historical, medical or documentary purpose rather than to arouse:
- nudity in works of art — painting, sculpture, photography, murals, performance — shown in or as part of their ordinary setting;
- anatomical, medical or scientific material;
- breastfeeding, and non-sexual nudity in a historical or documentary record;
- discussion of sexuality, sexual health or relationships, and the history of a place or a community — including districts known for their sex trade — told as history.
Context decides. The same photograph can be a study of a sculpture or a crop of it; the same walk can be the history of a district or a guide to its services. We look at how content is framed, captioned and narrated, and at what the Tour as a whole is for. We may remove content that is sexually suggestive even where nothing is explicit, particularly where it has no artistic or informational purpose, and our decision on context is final subject to the review route in section 17.
Not sure? Leave it out, or ask us at support@tourmuse.app before you publish.
17. Moderation, reporting and enforcement
Public content is moderated. Musings, Tour comments, profiles and Tour media are checked automatically, and content that breaks these Terms may be removed. We may also review it manually.
Private messages are not proactively monitored. We do not scan the content of your direct or group messages. That means a problem in a private conversation only reaches us if someone reports it, and the reporting route is how you tell us.
Where the Service offers it, you can report Content or an account to us, and you can block another user. If we act on a report, we may remove Content, restrict what an account can do, suspend it, or close it, depending on how serious and how repeated the problem is. Decisions about an account are always made by a person, and we will tell you what we did and why. If your account is suspended or closed, you can appeal once from inside the app, to a moderator who was not involved in the original decision. If we remove something you posted or restrict your account, or our automated checks remove something, you can ask for a person to review it by writing to support@tourmuse.app.
We aim to act proportionately, and the number of reports about something never decides the outcome on its own.
Reports involving a user under 18 — made by one, about one, or about a Tour one published — are handled by a person on our safety track ahead of other reports. The text and media of every Tour are checked automatically before it appears (section 9.1).
Adult content is treated exactly like any other prohibited content. It is caught by the same automated checks on public content, reported through the same route anywhere else — including in private messages — and dealt with on the same ladder: removal, a strike, restriction, suspension or closure, depending on how serious and how repeated it is. A Tour containing it is Withdrawn, its bookings are refunded under the Refund Policy, and any royalty on it is reversed. Repeated breaches close the account.
Two kinds of sexual content are handled as safety matters, ahead of everything else:
- Sexual content involving a minor. We remove it, preserve it as the law requires, report it to the National Center for Missing & Exploited Children, cooperate with law enforcement, and close the account.
- Intimate images shared without consent. If an intimate image or video of you — real, or generated or edited to look like you — has been posted on TourMuse without your consent, report it in the app or write to support@tourmuse.app. We remove it, and any copies of it we can identify, within 48 hours of a valid request, as federal law requires, and we act against the account that posted it. A valid request is made in writing, through the in-app report or by email, and includes your physical or electronic signature; enough information for us to identify and find the image or video; a brief statement that you believe in good faith it was published without your consent, with any information that helps us assess that; and how we can contact you. Someone authorized to act for you may make the request.
18. Copyright complaints
If you believe Content on TourMuse infringes your copyright, the Copyright Policy and DMCA Notices explains how to send us a notice, how a Creator can send a counter-notice, and what happens in between. It forms part of these Terms.
We terminate the accounts of repeat infringers in appropriate circumstances, as that policy describes.
19. Businesses, venues and Verified Locations
Museums, attractions and local businesses can take part in TourMuse — by publishing self-guided Tours, by sponsoring a Creator to make Tours for them, or by using TourMuse instead of audio-guide hardware.
Where the Service offers a Verified Location, a user may associate themselves with a place so that Tours can be grouped under it. Claiming a Verified Location is a statement that you are entitled to represent that place, and we may ask you to prove it or remove the association.
Business participation may be covered by a separate written agreement. Where one exists and says something different, it governs.
20. Third-party services
The Service links to and works with services we do not control — the app stores, mapping and location providers, our payout provider, and sign-in providers. We are not responsible for them, and your use of them is subject to their own terms.
21. Suspension and termination
You may stop using the Service and close your account at any time (section 4).
We may suspend or close your account, or remove Content, if you break these Terms, if we reasonably suspect fraud or abuse, if it is needed to protect other users or the Service, or if the law requires it. Where it is reasonable and lawful to do so, we will tell you first; where it is not — for example where there is a risk to someone’s safety — we will tell you afterwards.
If we learn that an account belongs to someone under 13, we close it and delete the personal information we hold about them, as the Privacy Policy describes.
Sections 6.2, 6.5, 10, 11, 22, 23, 24 and 25 survive the end of your account.
22. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that Tours are accurate, complete, safe or suitable for you, that the Service will be uninterrupted or error-free, that it will work with your device, or that location or mapping data is accurate. We are not responsible for the conduct of any user, on or off the Service.
23. Limitation of liability
23.1
To the extent the law allows, Muse Entertainment LLC and its officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill.
23.2
To the extent the law allows, our total liability for all claims arising out of these Terms or the Service will not exceed the greater of (a) the total amount you paid for Ticket Books through the Apple App Store or Google Play for use in TourMuse during the 12 months before the claim, and (b) US $100.
23.3
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
23.4 Your statutory rights
Some countries do not allow the exclusions and limits in this section, so they may not apply to you.
- European Union and United Kingdom — you have statutory rights in respect of digital content that is faulty, not as described, or not fit for purpose. Those rights apply in addition to these Terms.
- Australia — our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for other reasonably foreseeable loss or damage.
Where a statutory right gives you more than these Terms do, the statutory right applies.
24. Indemnification
To the extent the law allows, and to the extent this section is enforceable against you, you agree to cover our reasonable losses, damages and legal costs arising from your Content, your breach of these Terms, or your activity on an in-person Tour or Quest. We will tell you about any claim promptly and will not settle it in a way that admits fault on your behalf without asking you.
This does not apply to the extent the loss was caused by us.
25. Governing law and disputes
25.1 Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, except that section 25.3 is governed by the Federal Arbitration Act, and without affecting any mandatory consumer protection you have under the law of the country where you live.
25.2 Talk to us first
Most problems are faster to fix directly. Before starting a formal dispute, please contact us at support@tourmuse.app and give us 30 days to resolve it.
25.3 Arbitration and class action waiver
Except for small-claims actions and disputes about intellectual property, you and Muse Entertainment agree that any dispute arising from these Terms or the Service will be resolved by binding, individual arbitration rather than in court, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will be seated in Los Angeles County, California. You may choose to take part by phone or video, or to have the dispute decided on written submissions, so you will not need to travel. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Nothing in this section prevents either of us from seeking public injunctive relief in court where the law does not allow that right to be waived; the court case waits until the individual arbitration is decided.
If 25 or more similar claims are brought against us by or with the help of the same law firm or organization, they will be administered under the AAA’s Mass Arbitration Supplementary Rules.
You and Muse Entertainment each waive the right to a jury trial and to take part in a class action or class arbitration. If the class-action waiver is found unenforceable for a particular claim, that claim is removed from arbitration and heard in court; the rest of this section still applies.
25.4 Opting out
You may opt out of arbitration. Write to support@tourmuse.app within 30 days of first accepting these Terms, saying that you opt out and giving the email address on your account. Opting out does not affect anything else in these Terms, and we will not treat you differently for it.
25.5
This section does not apply where the law of the country you live in does not permit it.
If you are under 18, nothing in this section takes away a right the law gives a minor to disaffirm an agreement to arbitrate, and a parent or guardian may act for you in any dispute.
26. Changes to these Terms
We may change these Terms. If a change is material we will tell you through the app or by email before it takes effect, and we will update the version number and effective date at the top of this page.
If you do not agree to a change, stop using the Service and close your account before the change takes effect. Continuing to use the Service afterwards means you accept the new Terms. A change does not apply retrospectively to a dispute that already exists.
27. Apple and Google
These Terms are between you and Muse Entertainment, not with Apple or Google.
For the iOS app, the following applies in addition, as Apple requires of every app with its own terms:
- Acknowledgement. These Terms are between you and Muse Entertainment only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Scope of license. Your license to the iOS app is limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where Apple allows it.
- Maintenance and support. We are solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
- Warranty. We are solely responsible for any product warranty, express or implied, to the extent not disclaimed in section 22. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
- Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Contact. Questions, complaints and claims about the app go to us at the address in section 29.
- Third-party terms. You must comply with any applicable third-party terms when using the app, including your wireless carrier’s terms and the App Store Terms of Service.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of these Terms Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
For the Android app: your use is also subject to the Google Play Terms of Service. Google has no equivalent minimum-terms requirement; the acknowledgement, product-claim and intellectual-property paragraphs above apply to Google in the same way.
28. General
- Severability. If part of these Terms is unenforceable, the rest still applies.
- No waiver. If we do not enforce something straight away, we have not given up the right to.
- Assignment. You may not transfer your rights under these Terms. We may, in a merger, acquisition or sale of assets, or to a group company.
- Force majeure. Neither of us is liable for a failure caused by something genuinely outside our control.
- Export and sanctions. You may not use the Service where US export controls or sanctions prohibit it.
- Notices. We will contact you through the app or at the email address on your account, and it is your job to keep that address current. You contact us at the address in section 29.
- No third-party rights, except as section 27 says for Apple.
